General Terms and Conditions (Rental & Purchase)

Flexible rental models are available for VYRA devices (including weekly rental, pay-per-treatment, and long-term rental). The specific rental fees, security deposits, and durations are set out in the individual rental agreement or quotation. All quoted rental prices are in Euros including 20% Austrian VAT, unless expressly marked as net amounts.

Product displays in the online shop represent a legally binding offer to conclude a purchase agreement. By completing checkout via Stripe (credit card, Apple Pay, Google Pay, etc.), the customer accepts the offer and the contract is concluded. Order confirmations and electronic invoices are dispatched immediately by email. All shop prices include 20% VAT. Standard delivery within the European Union and Switzerland is free of charge. Any customs duties, import taxes, and foreign clearance fees for deliveries to Switzerland or third countries are to be borne by the customer.

Rental requests submitted via the contact and request form are non-binding. The rental agreement is concluded only upon explicit written confirmation (order confirmation email) by the Provider and receipt of any agreed security deposit.

Delivery and handover of purchased items will be made to the delivery address specified by the customer. For rental devices, delivery, instruction, and return take place by agreement (e.g. via insured parcel service or personal handover). Upon expiration of the agreed rental period, the device and all accessories, cables, and travel cases must be returned to the Provider in proper, cleaned, and fully operational condition in the original packaging.

The VYRA device may only be operated as intended for pulsed electromagnetic field (PEMF) applications on horses and in strict adherence to the operating instructions and contraindications provided. Transferring or subleasing the device to third parties without prior written consent from the Provider is prohibited. In case of malfunctions, error messages, or damage, use must be discontinued immediately and the Provider must be notified.

Statutory warranty provisions apply. The Provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for intent and gross negligence. In cases of slight negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations), limited to typical, foreseeable damage. Mandatory liability under the Austrian Product Liability Act remains unaffected. Important note: The use of the VYRA device is intended for horse wellness and recovery and does not replace veterinary diagnosis or emergency treatment. A licensed veterinarian must always be consulted in case of illness.

The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict of law principles. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the country of their habitual residence. To the extent legally permissible, the place of jurisdiction for all disputes is the competent court at the Provider's registered seat in Tyrol, Austria. Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
